Acceptance
of Terms: By accessing this website or using any services offered
through it, you agree to be bound by these Terms and Conditions. If you do not
agree with these terms, please refrain from using this website or submitting
information.
Services
Provided: This website offers professional transcription services,
including but not limited to:
Legal
transcription (court proceedings, discovery, legal interviews)
General
transcription (meetings, recordings, audio/video files)
All services are offered on a freelance basis, subject to
availability and discretion.
Confidentiality: All information submitted is treated with strict
confidentiality. Legal and personal documents will not be shared with third
parties without your explicit consent, unless required by law.
Data
Hosting and Cross-Border Transfer: This website is hosted by Yola, a third-party provider whose
servers are located in the United States. By submitting information through
this site, you acknowledge that:
Your
data may be transferred to and stored on servers outside of Canada.
Such
data may be subject to foreign laws, including lawful access by U.S.
authorities.

Client
Responsibilities: You are responsible for:
Providing
legible, audible materials.
Ensuring
you have the legal right to submit all materials.
Confirming
the accuracy of any names, spellings, or terminology provided.
Turnaround
and Revisions: Turnaround times vary depending on volume, file quality, and
service type. Revision requests must be made within five (5) business days
of receipt.
Payment
Terms: Fees are quoted in Canadian dollars (CAD) and are payable via agreed upon terms. Invoices are due upon receipt unless otherwise agreed in writing. Work may be paused for non-payment.
Refunds
and Quality: Refunds are issued at the sole discretion of the service
provider and will not apply in cases of:
Refund requests must be submitted within fourteen (14)
business days of delivery and include details about the issue. Refunds may
be issued for errors clearly attributable to the service provider or failure to
deliver services as described.
Dispute
Resolution: In the event of a dispute arising from these Terms or
services, both parties agree to seek resolution amicably through negotiation or
mediation before pursuing any legal action.
Intellectual
Property: In accordance with Canadian copyright law, the certified transcript produced
through this service is considered a literary work and remains the intellectual
property of the transcriptionist, unless otherwise agreed in writing.
Upon full payment, clients are granted a
non-exclusive, non-transferable license to use the completed transcript for
their personal, legal, or court-related purposes. This license does not confer
copyright ownership.
The content of the court proceeding itself
(e.g., spoken words, facts, rulings) remains public domain or Crown property
where applicable. However, the transcriptionist retains copyright over the
transcript’s formatting, editorial preparation, and statutory certification.
Reproduction, publication, or distribution of
the transcript beyond its intended use may require prior written permission.
Moral rights, as defined under the Canadian Copyright Act, remain with the
transcriptionist.
Retention and Deletion: By using this website and submitting
any personal or sensitive information, including legal documents and
transcription files, you acknowledge and agree that such data will be retained
securely for up to six
(6) months from the date of submission. After this period, the data
will be permanently deleted unless you provide written instructions to retain
it longer. If you do not agree to this retention period, please do not submit
your information through this website and contact us directly to discuss
alternative arrangements.
Limitation
of Liability: We are not liable for:
Errors
due to unclear audio.
Loss
of profits, data, or damages resulting from transcription use.
Unauthorized
access to information, unless due to our negligence.
Maximum liability is limited to the amount paid for the
specific transcription service.
Indemnification: You agree to indemnify, defend, and hold harmless the service provider, its affiliates, and their respective
officers, directors, employees, and agents from and against any claims,
liabilities, damages, losses, or expenses, including legal fees, arising out of
or in any way connected with your use of our services, your violation of these
Terms, or your submission of any materials.
Force Majeure: The service provider shall
not be held liable for any failure or delay in performing its obligations under
these Terms due to causes beyond its reasonable control, including but not
limited to acts of God, natural disasters, pandemics, war, terrorism, strikes,
government restrictions, or technical failures.
Governing
Law: These Terms shall be governed by the laws of the Province of
Ontario and the laws of Canada.
Changes
to Terms: We reserve the right to update or modify these Terms at any
time. Changes will be posted on this page with the effective date. Continued
use of the site or services after changes are posted constitutes your
acceptance.
